Welcome to Early Years Klique. These Terms of Service ("Terms") govern your use of the Early Years Klique website and platform at www.earlyyearsklique.co.uk (the "Platform"). By using the Platform you agree to these Terms.
These Terms apply to all users of the Platform. If you also purchase a paid Membership as a nursery or setting, our Membership Terms & Conditions apply in addition (and take precedence in respect of paid membership matters). What EYk is Early Years Klique is an online marketplace that introduces vetted, self-employed Early Years Practitioners to childcare settings ("Settings" or "Members"). EYk operates as a marketplace, not an employment agency or employment business in the regulatory sense, and the resulting service contract for any Booking is directly between the Setting and the Practitioner. EYk is not a substitute for a Setting's own statutory safer-recruitment, safeguarding, or employment compliance duties.

Who can use the Platform The Platform is intended for: Settings: registered childcare providers, nurseries, schools, childminders, or similar organisations operating in the United Kingdom. Practitioners: individuals aged 18 or over, legally entitled to work in the United Kingdom, who operate as self-employed Early Years professionals. By creating an account, you confirm that you meet these criteria and that all information you provide is true, accurate, and up to date.

Accounts 4.1 Creating an account You must register an account to use most Platform features. You are responsible for keeping your login credentials secure and for all activity under your account. 4.2 Approval Settings must hold an active paid Membership to access bookable Practitioner profiles. New Setting accounts may be reviewed by EYk before activation. Practitioners must complete EYk's vetting process before their profile becomes visible to Settings. 4.3 Account suspension or closure We may suspend, restrict, or close any account at our reasonable discretion if we believe a user has breached these Terms, applicable law, or our policies; if vetting cannot be completed or maintained; or if continued access would create risk to children, Practitioners, Settings, or EYk.

EYk vetting EYk carries out baseline vetting of Practitioners before their profiles become visible to Settings. EYk's standard vetting includes: Enhanced DBS verification (including the Children's Barred List check), confirmed via certificate or DBS Update Service Identity verification Right-to-work confirmation Two professional references, verified directly with the previous setting Qualification verification Confirmation of self-employed status (including UTR) A safeguarding self-declaration EYk's vetting is a baseline check to support Settings' due diligence. It is not a substitute for the Setting's own statutory safer-recruitment, supervision, and ongoing safeguarding duties under the EYFS Statutory Framework, Keeping Children Safe in Education, Working Together to Safeguard Children, or any other applicable law or regulation. Settings remain solely responsible for their own safer-recruitment processes, additional reference or qualification checks, induction, supervision, performance management, and compliance with their statutory obligations as a childcare provider. Costs of a Practitioner's own DBS check, qualification certificates, and other personal documentation are the responsibility of the Practitioner.

Bookings and engagement between Settings and Practitioners 6.1 Direct relationship for self-employed Practitioners When a Setting books or engages a Practitioner via the Platform, the resulting service contract is directly between the Setting and the Practitioner. EYk is not a party to that service contract. EYk introduces the parties, holds payment securely, and releases it once the shift is confirmed complete. 6.2 No guarantee of bookings or availability EYk does not guarantee any minimum volume of bookings to any Practitioner, or any minimum availability of Practitioners to any Setting. The Platform is a marketplace; outcomes depend on supply, demand, and individual decisions of users. 6.3 Time and attendance Practitioners record arrival and departure at each booking using EYk's time-tracking system (currently Jibble), via a QR code displayed at the Setting. Accurate clock-in and clock-out is required for shift confirmation and payment. Misuse of the time-tracking system — including clocking in or out on behalf of another person, or clocking in when not physically present at the Setting — is a breach of these Terms and may result in account termination and forfeiture of payment for the affected shift.

Payments 7.1 Payment processor Payments on the Platform are processed by Stripe. By making a payment, you agree to Stripe's terms and privacy policy. EYk does not store full card details. 7.2 Membership fees Setting Membership fees are charged monthly in advance as set out in the Membership Terms. 7.3 Booking payment flow Settings pay for each Booking at the time of booking. Payment is held securely and released to the Practitioner once the shift is confirmed complete via QR clock-out. 7.4 Permanent Placement fees Where a Setting engages a Practitioner first introduced through EYk on a permanent or fixed-term basis of three months or more, a Permanent Placement fee is payable to EYk as set out in the Membership Terms.

Acceptable use You agree not to: Use the Platform for any unlawful, fraudulent, harmful, or abusive purpose Misrepresent your identity, qualifications, vetting status, or employment status Circumvent EYk's fees (for example, by arranging engagements with a Practitioner first introduced through EYk outside the Platform to avoid a Permanent Placement fee) Discriminate against any user contrary to the Equality Act 2010 Harass, intimidate, or behave inappropriately towards any other user Upload false, misleading, defamatory, or unlawful content, including reviews Attempt to access another user's account, or interfere with the security or operation of the Platform Use the Platform to recruit users to competing services Breach of this clause may result in immediate suspension or termination of your account and may be reported to relevant authorities.

Safeguarding EYk takes safeguarding seriously. Our full position is set out in our Safeguarding Policy. In summary: If a child is at immediate risk of harm: call 999. Concerns about a child, or about an adult working with children, must be reported directly to the relevant statutory body — your local Multi-Agency Safeguarding Hub (MASH) for concerns about a child, or the Local Authority Designated Officer (LADO) for concerns about an adult in a position of trust. Do not route child-protection concerns through EYk — statutory bodies must be contacted directly to ensure urgent action. For concerns about the EYk Platform itself (misuse of the Platform, false profiles, breaches of EYk policies, complaints about another Platform user that do not meet the threshold above), contact hello@earlyyearsklique.co.uk. EYk will investigate platform misconduct, remove profiles where appropriate, and cooperate with any statutory enquiry. Settings retain their own statutory safeguarding duties at all times.

Reviews After a confirmed Booking, Settings may leave a written review and a star rating for the Practitioner, and Practitioners may leave a review for the Setting. Reviews must be honest, factual, and respectful. EYk may remove reviews that contain inappropriate, abusive, defamatory, or identifying information.

Intellectual property The Platform, including its text, design, logos, and software, is owned by or licensed to EYk and protected by intellectual property laws. You may not copy, reproduce, or use any part of the Platform other than for its intended purpose. Content you submit to the Platform (such as profile information, reviews) remains yours. By submitting it, you grant EYk a non-exclusive licence to host, display, and use it for the purpose of operating the Platform.

Limitation of liability Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be limited or excluded by law. Subject to that: We are not liable for the conduct, performance, suitability, or actions of any Practitioner or Setting. Engagements between Settings and Practitioners are their own responsibility. We are not liable for indirect, consequential, or pure economic losses. Our total liability to you under or in connection with the Platform will not exceed the greater of (a) the fees you have paid to EYk in the 12 months before the event giving rise to the claim, or (b) £100. We do not guarantee uninterrupted access to the Platform and are not liable for downtime, technical issues, or third-party service failures (including Stripe, Mapbox, Jibble, and our other processors).

Termination You may close your account at any time by contacting hello@earlyyearsklique.co.uk. We may close or suspend any account where required by these Terms or by law. Where a paid Membership is involved, the Membership Terms govern cancellation, refunds, and notice.

Changes to these Terms We may update these Terms from time to time. We will notify users of material changes by email or via a notice on the Platform. Continued use of the Platform after the change date constitutes acceptance.

Governing law and jurisdiction These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
